CASE HOBBIES


§ 1 General, Scope of Application

The General Terms and Conditions govern the contractual relationship between CASE HOBBiES and the natural and legal persons who use the internet offer or the eBay shop of CASE HOBBiES (hereinafter called Buyer). The GTC concern the use of all websites of CASE HOBBiES, in particular case-hobbies.de and trainmanagement.de, as well as all subdomains belonging to these domains and our eBay offers.

All items offered by us are not suitable for children, except our game software.

§ 2 Conclusion of contract

(1) Contract conclusion for orders in our Internetshop case-hobbies.de

(A) Our offers on the Internet represent a non-committal invitation to the buyer to order goods from us.

(B) By ordering the desired purchase item on the Internet, the buyer makes a binding offer to conclude a purchase contract.

(C) CASE HOBBiES is entitled to accept this offer within one day by sending an order confirmation. The order confirmation will be sent by e-mail. After expiry of the deadline specified in sentence 1, the offer shall be deemed to be rejected. Furthermore, we reserve the right to refuse the order, even if the order is automatically transmitted. The goods are sold out in the meantime or other important reasons exist.

(D) With the order, the buyer agrees to receive information from CASE HOBBiES by e-mail. The purchaser may at any time demand the termination of the sending of information by eMail via CASE HOBBiES. A short information is enough.

(2) Conclusion of our eBay offers

(A) The placing of goods on eBay in an online auction or at a fixed price (immediate purchase option) shall be deemed a binding offer to conclude the purchase contract. This offer can only be accepted within the specified period by a bid. The offer is addressed to the buyer, who makes the highest bid during the lifetime of the online auction and who fulfills any additionally stipulated conditions in the offer (for example, certain evaluation criteria).

(B) The buyer accepts the offer by submitting a bid on eBay. The bid expires if another buyer issues a higher bid during the lifetime of the online auction. Relevant for measuring the term of the online auction is the official eBay time.

(C) At the end of the determined term of the online auction, a contract with the highest bidding buyer is concluded. In the case of a direct purchase, a contract for the purchase of the offered goods is made at the fixed price fixed in the option, regardless of the expiry of the offer period and without an online auction, if the buyer exercises this option. The option can be exercised by every buyer as long as no bid has been placed on the goods or as long as further goods of the same type and quality are offered as part of a power auction.

(D) With the order, the buyer agrees to receive information from CASE HOBBiES by e-mail. The purchaser may at any time demand the termination of the sending of information by eMail via CASE HOBBiES. A short information is enough.

§ 3 Payment, due date, default of payment

(1) The payment of the goods is made in advance. We reserve the right to accept or exclude certain forms of payment in the individual case.

(2) In the case of payment by prepayment, the customer undertakes to pay the purchase price immediately after conclusion of the contract without delay. In the case of payment by cash on delivery, the customer undertakes to pay the purchase price upon delivery of the goods. If payment has been agreed on invoice, the customer undertakes to pay the invoice amount within 14 days after receipt of the goods. For SEPA direct debit mandates, debiting is effected within one week after the return of the SEPA direct debit mandate. When paying by credit card, the debiting is carried out after dispatch of the goods.

(3) If the customer is in default of payment, he is responsible for any negligence. He shall also be liable for accident on account of the performance, unless the damage would have occurred even in the case of timely performance.

(4) The purchase price is payable during the delay. The default rate is five percentage points above the base rate for the year.

(5) The assertion of further damage is not excluded.

§ 4 Delivery

(1) The delivery takes place by sending the object of purchase to the address notified by the buyer.

(2) The delivery takes place against the indicated packaging and shipping costs. For foreign deliveries the price for packaging and shipping is calculated separately by weight, unless otherwise stated. If the buyer wishes a special way of sending,
